Estate Real Estate Questions Randy Can Help Analyze

What Is the Property Worth?

Develop a current real estate market analysis and discuss the property's marketability, condition and likely buyer pool. Formal appraisal needs remain with a licensed appraiser when one is required.

Sell, Retain or Distribute?

Provide the real estate and financing information needed to compare a market sale with other property strategies being evaluated by counsel, the personal representative and beneficiaries.

Existing Mortgage & Liens

Identify mortgage-related questions, estimated payoff needs and title issues that should be investigated before listing or transferring the property.

Heir or Beneficiary Buyout

Evaluate whether an heir or beneficiary may have a realistic financing path to acquire the property or another party's interest, subject to the estate plan and legal requirements.

Property Preparation

Compare selling as-is with selective repairs, cleanout or preparation based on likely market impact, timing and estate objectives.

Sale & Closing Coordination

Coordinate the real estate transaction with counsel, title, the personal representative and other professionals so documentation and timing are addressed early.

Personal Representative Authority Matters

Colorado probate procedure uses the term Personal Representative for the person appointed to administer a decedent's estate. Court-issued Letters Testamentary or Letters of Administration document that appointment. The authority to act, the will, title, any specific devise, court orders and the facts of the estate should be reviewed by counsel before a property is marketed or transferred.

Colorado law gives personal representatives significant powers, but the details matter.

Colorado statutes address possession and preservation of estate property and powers concerning real property, including sale and conveyance in appropriate circumstances. This page does not determine whether a particular estate property may be sold without additional notice, consent or court action; that is a legal determination for estate counsel.

Bring in the Real Estate Review Before the Property Hits the Market

Early review can help identify occupancy, deferred maintenance, personal-property cleanout, insurance, mortgage payoff, title, valuation and financing questions before they interfere with a sale. It also gives counsel and the personal representative a clearer picture of likely market strategy and estimated proceeds.

Colorado's probate process also requires the personal representative to manage and protect estate assets. Real property can therefore involve practical responsibilities before a sale decision is made. Randy's role is to address the real estate and mortgage components while legal authority and fiduciary decisions remain with the personal representative and counsel.
